Buyeeは、tenso, inc.が独立して運営する代理購入サービスです。Buyeeの利用には、Buyee利用規約に従った別途会員登録が必要です。

Buyeeを利用して商品の購入は、顧客とtenso, inc.との間で直接行われます。

(Prohibited Acts)
The following acts and circumstances will be prohibited when using the Store through Buyee. If cobaco considers that any of the following acts or circumstances occurs to a Customer, cobaco may reject a proxy purchase of a Product made by tenso, inc. as requested by the Customer. In addition, in the event that any problem arises directly between the Customer and the Store, regardless of the use of Buyee, and it causes damage to cobaco, cobaco may claim compensation for damages directly from the Customer. cobaco may also file a criminal complaint in response to any criminal act committed by the Customer.

(サービス中断)
Cobacoは、天災（疫病、天災、戦争、テロ、暴動、法律や規制の制定、改正または廃止、政府当局の指導や命令、停電、通信回線、コンピュータ、ネットワーク機器またはその他のデバイスの故障、またはシステムメンテナンスやその他の理由による通信回線、コンピュータ、ネットワーク機器またはその他のデバイスの中断、遅延、停止またはデータ損失、無許可のアクセス、契約者、倉庫物流または輸送に影響を与える障害や事故、労働争議や設備事故を含むがこれに限らない）により、ストアサービスの一部または全部が停止した場合において、顧客が被った損害について一切の責任を負わないものとします。

Governing Law

The cobaco brand logo is a registered trademark of cobaco Ltd. It is registered by the Japan Patent Office and protected by intellectual property laws, and its use without our permission is prohibited.

Copyrights

Indemnification
1. In the event of any inconsistency between the Japanese version of these Terms and any other language version hereof, the Japanese version will prevail.
2.顧客がBuyeeの利用に関連して、顧客とtenso, inc.の間に発生した問題やその他の対立によって、何らかの損害（間接的または直接的）を被った場合、Cobacoはそのような損害について一切の責任を負わないものとします。ただし、この規定はCobacoに起因する理由がある場合には適用されません。
3.Cobacoと顧客は、これらの利用規約に定められた補償条項の不適用やその他の理由により、Cobacoが顧客または第三者に対して責任を負う場合、当該責任は直接的な損害に限定されることに事前に合意します。ただし、損害がCobacoの故意の不正行為または重大な過失によって引き起こされた場合はこの限りではありません。また、そのような責任に基づく損害賠償の金額は、いかなる場合においても顧客がCobacoに支払った金額を超えないものとします。

Severability
たとえこれらの規約のいずれかの条項またはその一部が消費者契約法またはその他の法律および規制によって無効または執行不能と見なされた場合でも、残りの条項は有効のままとします。

Other Terms
1. If there arises a need to bring a lawsuit concerning the use of the Store through Buyee, the Kobe District Court or the Kobe Summary Court will have exclusive jurisdiction for the first instance.
2.もしCobacoが顧客の販売価格の未払いまたはこれらの条件の違反により弁護士やその他の専門家のサービスを利用した場合、顧客は弁護士費用またはその他の専門家の費用を負担するものとします。

Governing Law

In cases where the exemption clauses stipulated in these terms do not apply, and the company is liable to the customer or a third party, except in cases of willful misconduct or gross negligence on the part of the company, liability shall be limited to direct damages, and the amount of damages based on such liability shall be agreed upon in advance by the company and the customer to be capped at the amount the customer has paid to the company in any case.

Separability
Even if any provision or part of this agreement is deemed invalid or unenforceable under the Consumer Contract Act or other laws and regulations, the remaining provisions shall continue to be effective.

Others
1. In the event that a lawsuit arises regarding the use of our store through Buyee, the Kobe District Court or the Kobe Summary Court shall be the exclusive court of first instance.
2. In the event that the customer fails to pay the transaction amount or violates these terms, any costs incurred by the company for hiring professionals such as lawyers will also be borne by the customer.
